Do You Need a Permit?
✓ Yes — at minimum a business license; cottage food permit status must be verified
Every food business operating in the CNMI requires a CNMI Business License from the Department of Finance, regardless of size. This is non-negotiable and applies to all sellers — home-based or otherwise.
Whether a separate cottage food permit or food establishment sanitary permit from CHCC EHDP is required depends on the enacted status of SB 24-31. If the bill created a cottage food registration, that registration process needs to be confirmed. If no cottage food pathway exists yet, a standard food establishment permit is required before selling from your home kitchen.
A food handler certification is required for food establishment employees under CNMI regulations. Whether cottage food operators are exempt from this requirement under SB 24-31 is unconfirmed — [VERIFY] with CHCC EHDP. Check bill status at cnmileg.net →

How to Get Licensed — Step by Step
Follow these steps in order. Some depend on the outcome of verifying SB 24-31's status — but the business formation steps apply regardless.
-
1[VERIFY] First
Confirm SB 24-31 Status with CHCC EHDP
Before spending money on permits, contact the Commonwealth Healthcare Corporation Environmental Health Disease Prevention Program in Saipan to confirm whether SB 24-31 was enacted and what specific permits it requires for home food sellers. Also check cnmileg.net for the current bill text. The answer to this question determines which permit path you take in Step 3.
-
2Always Required
Choose Your Business Structure and Register with CNMI Department of Commerce
Decide between operating as a sole proprietor (DBA) or forming an LLC. Both require registration with the CNMI Department of Commerce, Office of the Registrar at Capitol Hill, Saipan. LLC formation costs approximately $350 total and takes about one week. In-person filing is required — no online filing is currently available, though an online portal is in development at registrar.cnmi.gov. See the Start Your Business page for full details on sole proprietor vs. LLC.
-
3Required
Obtain Workers' Compensation Clearance Certificate
Before a business license can be issued, you must obtain a clearance certificate from the CNMI Workers' Compensation Commission. This is a standard prerequisite for all business license applications in the CNMI and does not typically involve a fee for the clearance itself — it confirms your compliance with workers' compensation requirements.
-
4Required
Apply for Your CNMI Business License
File your business license application with the CNMI Department of Finance, Division of Revenue and Taxation. You will need your Commerce registration documents and Workers' Compensation clearance certificate. Business licenses are renewed annually. Download the application form at finance.gov.mp or visit in person at the Dandan Commercial Center, Saipan.
-
5[VERIFY]
Obtain Cottage Food Permit or Food Establishment Sanitary Permit from CHCC EHDP
Based on what you confirmed in Step 1: if SB 24-31 is enacted and includes a cottage food registration, complete that registration with CHCC EHDP. If no cottage food pathway exists, apply for a standard food establishment sanitary permit from CHCC. Either way, CHCC EHDP is your contact — they are the food safety authority for all of CNMI under the FDA Food Code framework.
-
6[VERIFY] if required
Complete Food Handler Certification
The standard CNMI food handler certification costs $35 and requires an annual physical exam (additional cost varies by island: ~$55 in Saipan, ~$113 in Tinian, ~$187+ on Rota). Whether cottage food operators under SB 24-31 are exempt from this requirement is unconfirmed. If required, ANAB-CFP accredited online courses are accepted. For MHKO (prepared meal) operators, the higher-level Food Protection Manager Certification (CFPM) is strongly recommended and may be required.
-
7Recommended
Apply for an EIN from the IRS
If you form an LLC or plan to hire any help, an EIN (Employer Identification Number) is required. It's also recommended for sole proprietors to keep personal and business finances separate and to open a dedicated business bank account. Apply free online at irs.gov — processing is immediate.
-
8[VERIFY]
Obtain Market Vendor Permit (if selling at farmers markets)
If you plan to sell at the Sabalu Farmers Market in Susupe or the Garapan Street Market in Saipan, contact the market organizers directly to understand vendor application requirements, booth fees, and any additional food safety documentation they may require beyond what CHCC EHDP mandates.
🏠 Home Kitchen Inspection — What to Expect
Whether a home kitchen inspection is required depends on which permit pathway applies. Standard food establishment permits in CNMI would typically involve a CHCC EHDP inspection of the production space. The non-perishable cottage food framework under SB 24-31 may or may not require inspection — this varies significantly between jurisdictions.
If an inspection is required, CHCC inspectors will likely look for: a clean, sanitary kitchen environment free of pest evidence; proper separation of food production from household items; adequate handwashing facilities; appropriate food storage (dry goods off the floor, away from chemicals); and labeling practices. There is no requirement to have a commercial-grade kitchen — a standard home kitchen in good condition will satisfy most inspectors.
[VERIFY] the inspection requirement directly with CHCC EHDP when confirming SB 24-31's status.
Food Handler Certification — Island-by-Island Costs
CNMI's food handler certification system is administered by CHCC and requires an annual physical exam in addition to the certification course. Costs vary significantly depending on which island you are on.
Food Handler Certification
$35 certification fee + ~$55 physical exam at Marianas Health or another private clinic. Most cost-effective island for certification due to availability of private clinics.
Food Handler Certification
$35 certification fee + combined physical exam at Tinian Health Center. Slightly higher due to limited clinic options on island.
Food Handler Certification
$35 certification fee + $159.60 physical exam + $27 TB test at Rota Health Center. Optional X-ray adds $108.90 if TB screening requires follow-up. Rota Chamber of Commerce is actively advocating for reform of these costs.
Food Protection Manager (CFPM)
ANAB-CFP accredited Food Protection Manager certification — recommended for MHKO operators. Valid for 5 years, accepted territory-wide. Available via online training providers. Learn more →
Note on Annual Renewal
CNMI's food handler certification requires annual renewal — more frequent than most U.S. states (which typically require renewal every 2–3 years). The Rota Chamber of Commerce submitted a formal request in early 2026 to review this requirement. The annual renewal rule may change — check current CHCC rules when obtaining your certification.

Before investing time in any other step, call or visit CHCC Environmental Health Disease Prevention Program in Saipan and ask two questions: (1) Has SB 24-31 been enacted and signed? (2) If so, what does it require from home food sellers specifically? That single conversation will clarify your entire permit pathway. You can also check cnmileg.net for the current status of the bill.
