Why Some Categories Are Separate
West Virginia's cottage food framework under §19-35-6 is intentionally narrow. It covers shelf-stable, non-potentially hazardous foods produced in a home kitchen without inspection. Foods that fall outside that definition — because of temperature control, alcohol, animal origin, or regulatory overlap with federal agencies — need their own licensing path.
This isn't a barrier to entry as much as a different door. Each category below has a legitimate pathway in West Virginia. Some are straightforward ($35 farmers market permit, paperwork only). Others are genuine commercial undertakings (brewery license, $50,000+ in equipment). Knowing which is which up front saves time and money.
